Non-Highway Vehicle Operation on Village Streets: Village granted authority to authorize a person to drive and operate a Non-Highway Vehicle on Village Streets. No person shall operate a Non-Highway Vehicle without first obtaining a permit from the Chief of Police as provided herein. Permits shall be granted for a period of one year. The cost of a permit shall be $50.00.
All persons operation Non-Highway Vehicles must be observant of, and attentive to, the safety of themselves and others, including their passengers, other motorists, bicyclist and pedestrians. All person who operate or ride in a Non-Highway Vehicle on Village Streets do so at their own risk and peril. The Village disclaims any liabiity under any theory of liability for permitting Non-Highway Vehicles to be operated on Village Streets. Any person who violates any provisions of this Chapter or any person who operates a Non-Highway Vehicle in violation of any provisions of this Chapter shall be punished by a fine of not less than $100.00 nor more than $750.00 for each offense. Any second or subsequent offense shall result in a revocation of the authority to operate a Non-Highway Vehicle on Village streets for a period of not less than three years. The length of the revocation shall be determined by the Board of Trustees. In addition, all court costs, which shall include all costs incurred by the Village in prosecuting the case, shall be recoverable from anyone convicted of a violation of this chapter.
